Compensation rates under the Longshore and Harbor Workers’ Compensation Act, 33 U.S.C. §901, et seq., and its extension acts, including the Outer Continental Shelf Lands Act, 43 U.S.C. §1333, et seq., Defense Base Act, 42 U.S.C. §1651, et seq., and Non-Appropriated Funds Instrumentalities Act, 5 U.S.C. §8171, et seq., are guided by the National Average Weekly Wage (NAWW), determined each October 1st by the United States Department of Labor. The minimum compensation rate is one half the NAWW and the maximum compensation rate is twice that of the NAWW.

Effective October 1, 2025, the NAWW has exceeded $1,000 for the first time, determined to be $1,041.35. The minimum compensation rate is therefore $520.68 and the maximum compensation rate is $2,082.70. Workers receiving the maximum compensation rate will receive $108,300.40 annually. Minimum compensation rates do not apply to the Defense Base Act by statutory provision.
