André J. Mouledoux successfully obtained summary decision in a personal injury case, and in the process were awarded attorneys’ fees and costs due to plaintiffs’ frivolous prosecution of the matter. On motion for summary judgment, Messr. Mouledoux argued that there was no basis in fact or law for plaintiffs’ claims against the client, and sanctions were warranted because plaintiffs continued to prosecute the lawsuit for more than a year following receipt of clear documentation that exonerated the client. Judge Ellen Kovach of the Twenty Fourth Judicial District Court for the Parish of Jefferson agreed and awarded $5,449.00 in attorneys’ fees and costs.
