Louisiana Supreme Court Denies Writ, Leaves MBLB First Circuit Victory in Place

In November 2022, Mouledoux, Bland, Legrand & Brackett reported on Georges Legrand and Trevor Cutaiar’s Louisiana First Circuit Court of Appeal victory in Clarence Jackson v. Plaquemine Point Shipyard, LLC and Starr Indemnity & Liability Company. In that decision, the First Circuit reversed the judgment of the trial court and found that Jackson, a welding foreman, was not a seaman and that the work platform on which he was injured was not a vessel. Following the First Circuit’s decision, Jackson filed an application for writ of certiorari with the Louisiana Supreme Court.

We are pleased to report that, on February 14, 2023, the Louisiana Supreme Court denied that writ application, leaving the First Circuit decision intact.
